Carriers: Compatible with all major US carriers. Carriers are not liable for delayed or undelivered messages.

This is a transactional service tied to offers you generate -- most messages are user-initiated, plus the closing-date reminder described above. We do not send marketing or promotional messages.

4. Data Sharing

We do not sell, rent, or trade your personal information. We share data only with:

• Twilio — SMS delivery (phone number, message content)
• Stripe — Payment processing (billing details)
• Railway — Hosting provider; our app server and database run there
• SendGrid — Inbound email: receives emails (and attached contracts) forwarded to tc@check.txtanoffer.com; also our backup outbound email provider
• DocuSign — E-signature: when you send an offer for signature, the PDF and the signers’ names and emails
• Your webhook — If you set up a webhook (e.g. Zapier), offer data is sent to the URL you choose
• Resend — Outbound email: sends TC Check report emails (your email address, the property address and the findings), offer emails with the generated PDF, and account notifications

We may disclose information if required by law, legal process, or to protect the rights and safety of our users or the public.

5. Data Retention

• Generated PDFs: on the free trial, stored for download and deleted after 30 days; on a paid plan, kept 5 years in your dashboard
• Brokerage plan: offers and amendments drafted by an agent linked to a brokerage are kept for 5 years from creation while the agent stays linked, viewable and exportable by that brokerage
• Brokerage contract archive: executed contracts a brokerage forwards from a linked email or uploads while signed in are stored for 5 years from when they are added (or until the brokerage deletes them), visible only to that brokerage's signed-in users, and exportable anytime. Files checked outside the archive are still deleted after the check (bulk uploads: when the batch finishes).
• TC Check records: for each check we keep a record (your email if you gave one, and short issue codes — not the file, the property address or the form contents). Records older than 90 days are removed by an automatic cleanup that doesn’t run on a fixed schedule, so some may last longer than 90 days. We also keep a per-browser count of free checks (a random browser ID and your email if you gave one) with no set expiry.
• TC Check bulk uploads: we keep your email, the number of files, and each file’s original filename, whether it was recognized, its issue count and up to 10 issue messages, with no set expiry. Anyone with the batch results link can view them.
• Account data: retained while your account is active and for 90 days after cancellation
• Billing records: retained as required by applicable tax and accounting laws
• SMS logs: retained for 90 days for support and debugging purposes

Note for licensees: In Texas, TREC Rule §535.2 requires brokers to independently retain offers, contracts, and related addenda for at least 4 years from closing or termination. Our 30-day PDF retention does not satisfy that requirement. The Brokerage plan's contract archive can hold the executed contracts your brokerage forwards or uploads, plus the drafts generated here. It helps with that requirement, but it is not a guarantee of compliance — you remain responsible for keeping complete transaction records under your own state's rules.

6. Data Security

We implement reasonable technical and organizational measures to protect your data:

• Encryption in transit: the site is served over HTTPS
• Infrastructure: hosted on Railway
• Access: processing is automated; TxtAnOffer’s founder can access stored data for support and debugging
• Payment data: Handled exclusively by Stripe (PCI DSS Level 1); card numbers never touch our servers

No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

7. Your Rights

You may:

• Request access to your personal data
• Request correction or deletion of your data
• Opt out of SMS communications (reply STOP)
• Cancel your subscription at any time

To exercise these rights, contact us at support@txtanoffer.com.

8. Children's Privacy

The Service is intended for licensed real estate professionals and is not directed at individuals under 18. We do not knowingly collect information from minors.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
